Vacant plots are becoming challenge to the society these days. Today in Delhi-NCR, there are number of localities where vacant plots have become a big problem for the people living in the neighbourhood.

In several localities of Delhi-NCR vacant plots have become dumping grounds of waste products or garbage which directly affects the people living in localities as these waste dumps creates the best suited environment for the mosquitos which further spread epidemic diseases like dengue, malaria etc. in the localities.

As in the above situations, it has been seen that vacant plots cause spread of epidemic diseases in the locality thus interferes in the private use and enjoyment of land of the neighbours in the locality.

In torts, “A Private nuisance is a substantial and unreasonable interference with the private use and enjoyment of one’s land” which is similar to the case of dumping of garbage on vacant plots as it directly or indirectly affects the use and enjoyment of land of people in the locality.

So it’s definitely a big question whether vacant plots issues comes within the boundaries of Private nuisance in torts or not?
